Terms of Service — Fenua'p

Fenua'p is operated by a sole trader established in French Polynesia. Registration details (Tahiti number, patente) will be published here once obtained. Contact: [email protected].
1. Purpose
These terms govern the use of the Fenua'p application and website (the "Platform"), published by Fenua'p, French Polynesia. The Platform connects Users (customers) with independent Providers offering accommodation, food, activities, rentals and transport services.
Using the Platform means accepting these terms.
2. Definitions
- Platform: the mobile app, the website and related services.
- User: any person holding a customer account.
- Provider: an independent professional offering services through the
Platform, holding the authorisations required for their activity.
- Service: the service supplied by the Provider to the User.
3. Account
3.1. Accounts are reserved for individuals aged 18 or over with legal capacity to contract.
3.2. Users provide accurate information and keep it up to date. The email address must be verified: a confirmation link is sent at sign-up and the account is fully active only after verification.
3.3. Credentials are personal and confidential. Users must inform Fenua'p without delay of any unauthorised use.
3.4. Users may delete their account at any time from the app (Account → Privacy). Deletion anonymises the profile; data required for Providers' accounting and legal obligations is retained (see the Privacy Policy).
4. Role of the Platform
4.1. Fenua'p provides a matching service. It is not a seller, a provider, a carrier, nor a host of the Services.
4.2. The service contract is concluded directly between the User and the Provider, who alone is responsible for its performance, the accuracy of their offer, their prices and their professional obligations (insurance, licences, permits).
4.3. Fenua'p checks certain items declared by Providers (identity, professional documents) and displays a badge where those checks succeeded. This badge implies no guarantee as to the quality of the Service.
5. Bookings, prices and payment
5.1. Prices are shown in Pacific francs (XPF), all taxes included, and set freely by each Provider, within regulated rates where they exist (notably passenger transport, order no. 1540 CM of 6 September 2023).
5.2. A confirmed booking binds both User and Provider according to the cancellation terms shown on the offer.
5.3. Cancellation terms, any deposits and required documents (licence, ID) are shown on each offer before booking.
5.7. During the launch phase, Fenua'p collects no payment in respect of the services offered in the Application and takes no part in the flow of funds. Payment is made DIRECTLY between the User and the Provider, in cash or by instant transfer. Fenua'p is neither the seller, nor the provider, nor the collector: it supplies a matching service. The sale or service contract is concluded between the User and the Provider, who is solely responsible for it.
6. User obligations
Users undertake to: provide accurate information; attend booked services or cancel them within the stated notice; respect property, places and people; not publish unlawful, defamatory, hateful or misleading content; not circumvent the Platform to avoid its rules.
Repeated failures (unannounced no-shows, abusive behaviour) may lead to restriction or suspension of the account.
7. Reviews and content
7.1. A review may only be left after a service has actually taken place.
7.2. Reviews are published under the pseudonym chosen by their author in the app. Neither their real identity nor their contact details are made public or disclosed to the Provider.
7.3. Fenua'p may remove content that is manifestly unlawful, off-topic or harmful to a person.
8. Availability and liability
8.1. Fenua'p uses reasonable means to keep the Platform available, without guaranteeing uninterrupted service (maintenance, incident, force majeure).
8.2. Fenua'p cannot be held liable for the performance or non-performance of a Service, which is the Provider's sole responsibility.
8.3. Fenua'p may temporarily suspend a service vertical (transport, food, stays, experiences, rentals) for safety or maintenance reasons.
9. Intellectual property
The Fenua'p brand, logo, interfaces, texts and visuals are protected. Any reproduction or reuse without permission is prohibited. Content published by Providers remains theirs; they grant Fenua'p a licence to display it on the Platform.
10. Personal data
Data processing is described in the Privacy Policy, which forms an integral part of these terms.
11. Changes to the terms
Any substantial change is notified in the app and requires fresh acceptance. The terms accepted at the time of a booking remain those applicable to that booking.
12. Governing law and disputes
These terms are governed by the law applicable in French Polynesia. In the event of a dispute, an amicable solution will be sought by writing to [email protected]. Failing that, the competent courts of Papeete will have jurisdiction.
